Insurance law involves the regulation of the business of insurance, the interpretation of insurance policies and the administration of claims handling. Insurance policies often include complex terminology with regard to the definitions of policy terms, interpretation of covered property and insuring agreements, exclusions from and limitations on coverage and policy conditions.
Issues regarding insurance coverage arise when there is a dispute between an individual or a business with their insurance company on whether or not the policy of insurance covers a particular loss or claim. An expert witness is qualified to express expert opinions in a case if he or she possesses special skill, knowledge, training, experience or education in subject matter that is ordinarily beyond the knowledge of a layperson. Insurance claims and cases often require the input of expert witnesses on issues relating to the interpretation of the language of an insurance policy and also whether an insurance company, in considering a policyholder’s claim, has conducted itself in good faith or bad faith.
